IRS Tax Appeals

Your Right to Appeal an IRS Decision

As a taxpayer, you have important rights — including the right to appeal many IRS decisions. However, there are strict deadlines that you must meet. If you receive a notice from the IRS, it is critical that you act quickly to protect your rights.

At Michelle Turpin, P.C., we represent taxpayers in all stages of IRS appeals. Whether you have received a Notice of Deficiency, disagree with an audit determination, or want to appeal a collection action, our experienced tax attorneys can help.

Important Deadlines You Must Know

30

30-Day Notice (Notice and Demand)

If you receive a Notice and Demand for Payment, you have 30 days to appeal the underlying liability in court before the IRS can request a judgment against you.

90

90-Day Notice (Notice of Deficiency)

If you receive a Notice of Deficiency (90-day letter), you have 90 days to file a petition in the U.S. Tax Court. Missing this deadline can severely limit your options.

IRS Office of Appeals

If you disagree with an IRS decision, you may request a conference with the IRS Office of Appeals. This is an informal process where an Appeals Officer will review your case and attempt to resolve the dispute.

U.S. Tax Court

If you receive a Notice of Deficiency (90-day letter), you have the right to file a petition in the U.S. Tax Court without first paying the disputed tax. This is one of the most powerful tools available to taxpayers.

Collection Appeals

If the IRS intends to take collection action against you, you may be able to appeal through the Collection Appeals Program (CAP) before the levy or seizure occurs.

Audit Reconsideration

If you disagree with the results of an IRS audit, you may request audit reconsideration. This is particularly useful when you have new information or documentation that was not previously considered.

Offers in Compromise Appeals

If your offer in compromise has been rejected, you have the right to appeal that decision. Our attorneys can help you present your case to the IRS Office of Appeals.

Installment Agreement Appeals

If your request for an installment agreement has been denied or you disagree with the terms, you may appeal through the Collection Appeals Program.

Don't Miss Your Appeal Deadline

If you have received an IRS notice with a deadline, time is of the essence. Missing a deadline can mean losing your right to appeal and being forced to pay disputed taxes before you have your day in court.

Our experienced tax attorneys can help you understand your rights and meet critical deadlines. Call 801-685-0552 today for a consultation.
