Innocent Spouse Tax Relief
Under the innocent spouse provisions, a spouse who files a joint tax return can be relieved of responsibility for the taxes due if their spouse (or former spouse) improperly reported items or omitted information on their joint tax return.
Find Relief from Joint Tax Liability
When you file a joint tax return, both spouses are typically held jointly and severally liable for the taxes owed. If your spouse or former spouse understated income, claimed improper deductions, or otherwise committed tax errors or fraud, you may qualify for Innocent Spouse Relief and be freed from the resulting tax, penalties, and interest.
Do You Qualify for Innocent Spouse Relief?
The IRS uses several tests to decide whether innocent spouse relief is appropriate. Generally, you must show that you did not know and had no reason to know of the understatement; that it would be unfair to hold you liable; and that the relief is requested within the applicable time limit. There are three categories of relief: traditional Innocent Spouse, Separation of Liability, and Equitable Relief.
- Traditional Innocent Spouse Relief for understated tax on a joint return
- Separation of Liability Relief when you are divorced or separated
- Equitable Relief for circumstances not covered by the other two
- Injured Spouse claims to recover your portion of a joint refund
- Defending against IRS collection while your petition is pending
- Communicating with the IRS so you no longer have to deal with them directly
